三部門發文,協同推進“互聯網+不動產登記”方便企業和群眾辦事(3)
三、推廣使用電子證照及電子材料。按照法(fa)律(lv)法(fa)規(gui)規(gui)定,電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)不(bu)(bu)動產登(deng)記證(zheng)(zheng)(zheng)書(shu)證(zheng)(zheng)(zheng)明(ming)(ming)與(yu)紙質(zhi)不(bu)(bu)動產登(deng)記證(zheng)(zheng)(zheng)書(shu)證(zheng)(zheng)(zheng)明(ming)(ming)具(ju)(ju)有同(tong)等(deng)法(fa)律(lv)效(xiao)力,各地要(yao)積極推廣(guang)(guang)應(ying)用(yong)。有條(tiao)(tiao)件的地方,應(ying)當核發符合(he)國家標準的電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)證(zheng)(zheng)(zheng)書(shu)證(zheng)(zheng)(zheng)明(ming)(ming);暫(zan)時不(bu)(bu)具(ju)(ju)備(bei)條(tiao)(tiao)件的,要(yao)努力提供紙質(zhi)證(zheng)(zheng)(zheng)書(shu)證(zheng)(zheng)(zheng)明(ming)(ming)郵寄、自助打(da)印(yin)等(deng)服務(wu)(wu),方便企業群眾不(bu)(bu)見面辦理。在不(bu)(bu)動產登(deng)記、申報納稅和抵押(ya)放(fang)貸等(deng)服務(wu)(wu)中推廣(guang)(guang)使用(yong)電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)簽(qian)名(ming)、電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)印(yin)章(zhang)、電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)合(he)同(tong)、電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)證(zheng)(zheng)(zheng)書(shu)證(zheng)(zheng)(zheng)明(ming)(ming),符合(he)規(gui)定條(tiao)(tiao)件的電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)簽(qian)名(ming)與(yu)手(shou)寫簽(qian)名(ming)或者蓋(gai)章(zhang)、電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)印(yin)章(zhang)與(yu)實(shi)物印(yin)章(zhang)具(ju)(ju)有同(tong)等(deng)法(fa)律(lv)效(xiao)力,經電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)簽(qian)名(ming)或加蓋(gai)電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)印(yin)章(zhang)的電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)材料合(he)法(fa)有效(xiao),通過共享獲得的信息以(yi)及當事(shi)人(ren)提交的電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)材料可以(yi)作為辦事(shi)依據,電(dian)(dian)子(zi)(zi)(zi)(zi)(zi)材料可以(yi)不(bu)(bu)再以(yi)紙質(zhi)形式歸(gui)檔(dang)。具(ju)(ju)備(bei)條(tiao)(tiao)件的地方銀保監部門與(yu)不(bu)(bu)動產登(deng)記機(ji)構可以(yi)聯合(he)制定不(bu)(bu)動產抵押(ya)合(he)同(tong)示范文本。
四、進一步提升登簿和傳輸數據質量。規范登(deng)(deng)簿(bu)(bu)行為,嚴格按要求填(tian)(tian)寫(xie)登(deng)(deng)記簿(bu)(bu),不得隨意填(tian)(tian)報(bao)或(huo)擅自(zi)減少數(shu)(shu)據項內容(rong)。充分運用(yong)(yong)(yong)信息(xi)化手段(duan)輔助登(deng)(deng)記簿(bu)(bu)的填(tian)(tian)寫(xie)、審核(he)和(he)校(xiao)驗工作,確保(bao)登(deng)(deng)記簿(bu)(bu)內容(rong)全面(mian)、準確,不重、不漏(lou)。登(deng)(deng)記簿(bu)(bu)內容(rong)原(yuan)則(ze)上不得空缺,確實無法填(tian)(tian)寫(xie)的個別欄目(mu),要用(yong)(yong)(yong)斜杠“/”填(tian)(tian)充并在登(deng)(deng)記簿(bu)(bu)附記欄中備(bei)注原(yuan)因;能夠通過已有信息(xi)反寫(xie)的直(zhi)接(jie)調用(yong)(yong)(yong),不再重復錄入。全面(mian)提高各級信息(xi)平(ping)(ping)臺(tai)接(jie)入質(zhi)量,確保(bao)做到在登(deng)(deng)簿(bu)(bu)環節通過系(xi)統(tong)自(zi)動上傳數(shu)(shu)據,嚴禁人工上傳;將(jiang)登(deng)(deng)記業務類(lei)型和(he)數(shu)(shu)量歸集到登(deng)(deng)簿(bu)(bu)日志,并通過系(xi)統(tong)當(dang)天(tian)定時自(zi)動上報(bao);利(li)用(yong)(yong)(yong)國家級信息(xi)平(ping)(ping)臺(tai)接(jie)入監管系(xi)統(tong),監測本(ben)地接(jie)入情況,及時解決異常問題。
五、深化應用不動產單元代碼。健全地籍調查工作機制,建設項目用地預審與規劃選址、農轉用審批、建設用地規劃許可、土地供應、建設工程規劃許可、確權登記等土地、規劃管理各環節要規范開展地籍調查,統一調查名目、地物標識、技術標準、成果管理和數據入庫,確保調查作業協同銜接、地籍成果共享沿用。對土地、房屋等不動產開展首次地籍調查后,界址、權屬、用途沒有發生變化的,調查成果應一直沿用,避免重復作業。按照《不動產單元設定與代碼編制規則》要求,在宗地、房地一體不動產單元新設或變更時,編制統一的不動產單元代碼,建立不動產單元表。不動產單元代碼要在建設用地規劃許可證、土地有償使用合同(劃撥決定書)、建設工程規劃許可證、抵押合同、完稅憑證、登記簿冊證等材料中予以記載,用不動產單元代碼關聯起不動產交易、稅款征收、確權登記等各項業務,實現“一碼關聯”,確保業務環節前后銜接一致、真實準確,便利共享查詢追溯。
